LATEST CASE RESULTS

Although the results of actual cases are displayed, Anelli Xavier cannot represent such results to be indicative of those that may be obtained in any particular case.

Client was charged with 3rd DWI (priors from 2007, 2009) and had a BAC of .23. Client was looking at 4 years State Prison.We were successful in negotiating an offer to keep the client out of state prison with either 1 weekend or 240 hours community service.
Client was charged with REFUSAL and we were able to win the refusal hearing because we were able to show that the paperwork indicated that the request for the breath sample occurred 2:05 after she was arrested, thus the judge applied the two hour rule and ruled the refusal invalid.
Client was charged with Aggravated DWI and 8 other tickets, through case review and negotiations we were able to negotiate a simple violation of DWAI.

New York State DWI Charge?

Consequences that can flow from a DWI arrest and prosecution include: loss of your driver’s license, heavy fines, court costs and extensive administrative fees, probation, jail or state prison, vehicle impoundment or forfeiture, an ignition interlock device put on your car, etc. New York State treats Driving While Intoxicated (“DWI”) seriously. The DWI laws are strict.

Aside from the more obvious legal consequences of dealing with the police, the courts, and the Department of Motor Vehicles (“DMV”), there are practical consequences that often flow from a DWI arrest or conviction. Since DWI is a crime, and a DWI conviction will give you a permanent “criminal” record, you could lose your job or be prevented certain future employment – especially if it is State job, is law enforcement associated, or involves driving. If you are a commercial driver, you could lose your privilege to drive commercially for at least one year. A DWI conviction can cause your insurance rates to skyrocket; sometimes insurance companies will cancel your coverage altogether. There are other, “hidden” DWI penalties, such as limitations on travel outside of the state or abroad. A DWI prosecution and conviction may bring community service and substance abuse treatment.
