A Cape Coral man was finally convicted this past Thursday for the death of woman in a 2005 drunk-driving accident.

The Cape Coral man is Bradley Todd Hill. He is a 38-year-old facing up to 20 years in prison after being convicted of one count each of DUI manslaughter, vehicular homicide, DUI causing property damage and two counts of DUI causing serious bodily injury.

The accident occurred on Oct. 8, 2005. Hill was heading south on Santa Barbara Boulevard approaching Trafalgar Parkway when he struck Racheal Daniels’ Chevy Camaro. The truck flipped several times before hitting a light pole. The passengers in Daniels’ car, Hilary Walters and Bradley White, were immediately ejected from the vehicle. Walters died at the scene, White was injured and later released.

According to reports, police testified during the trial that Hill refused to take a breathalyzer and refused all field sobriety testing after the crash.

During the two-day trial, police testified Hill would neither take a breath test nor would he undergo sobriety tests after the crash. The testimony also revealed he had a .161 blood alcohol level and Daniels, the driver of the Camaro, had a .174 blood alcohol level. She pleaded guilty to DUI in 2006.

Hill told police after the crash Daniels pulled out in front of him and he had the green light. This, coming from the man who has over 20 violations on his driving record. His attorney told jurors during the closing of the trial that both drivers were at fault, although the case was one concerning an accident without fault. Police sided with Daniels and not Hill, although both were intoxicated at the time.

“Why is he in a different position?” than Daniels, who drove the other vehicle drunk, Viacava asked. “That’s just downright unfair.”
